This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use the Service and tells You about Your privacy rights and how the law protects You.

We use Your Personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

  • Account means a unique account created for You to access our Service or parts of our Service.

  • Application means the software program provided by the Company, Installed by You on any electronic device, named PetroByte

  • Company (referred to as either "the Company", "We", "Us", "BeanByte" or "Our"in this Agreement) refers to BeanByte Softwares Private Limited, located at Vatika infotech City, Jaipur-302026, Rajasthan.

  • Country refers to: Rajasthan, India

  • Device means any device that can access the Service such as a computer, a smartphone or a digital tablet.

  • Personal Data is any information that relates to an identified or identifiable individual.

  • Service refers to the PetroByte Application.

  • Application refers to the PetroByte Web Application Portal.

  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

  • Trial Users refers to individual user or a group of users where the User has started using our Service on trial basis, and he has stopped using Our Service when trial period gets over.

  • Regular Users refers to individual user or a group of users where the User has started using our Service as on trial basis or on paid basis, and he is continuously purchasing our services from BeanByte or its authorised Reseller referring to available licence validity plans.

  • Left Off Users refers to individual user or a group of users where the User has started using our Service as on trial basis or on paid basis, and in past he purchased our services from BeanByte or its authorise Reseller but currently his licence validity is expired and the User did not purchase service from Us.

By using our Website or Services, you hereby consent to our Privacy Policy and agree to its terms. Please read them carefully.


This Privacy Policy is an electronic record in the form of an electronic contract formed under the information Technology Act, 2000 and the rules made thereunder and the amended provisions pertaining to electronic documents / records in various statutes as amended by the information Technology Act, 2000. This Privacy Policy does not require any physical, electronic or digital signature.

This Privacy Policy is a legally binding document between you and BeanByte. (both terms defined). The terms of this Privacy Policy will be effective upon your acceptance of the same (directly or indirectly in electronic form, by clicking on the I accept tab or by use of the website or by other means) and will govern the relationship between you and BeanByte. for your use of the website “Website”.

This document is published and shall be construed in accordance with the provisions of the Information Technology (reasonable security practices and procedures and sensitive personal data of information) rules, 2011 under Information Technology Act, 2000; that require publishing of the Privacy Policy for collection, use, storage and transfer of sensitive personal data or information.

Please read this Privacy Policy carefully by using the Website or Service, you indicate that you understand, agree and consent to this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not use our Website or Service.

By providing us your Information or by making use of the facilities provided by the Website or Application, You hereby consent to the collection, storage, processing and transfer of any or all of Your Personal Information and Non-Personal Information by us as specified under this Privacy Policy. While registering for Our Service, Users are required to provide certain information for the registration process. The Information as supplied by the users enable us to complete registration process. Personally identifiable information may include, but is not limited to:

  • Business Legal Name

  • Business GSTIN

  • Business Address

  • Business Type

Such information will not be considered as sensitive if it is freely available and accessible in the public domain or is furnished under the Right to Information Act, 2005 or any other law for the time being in force.

• Business Data

Data Collection From Website

We do not collect any type of business data from Website.

Data Collection From Application

While Using Our Services, We ask you to provide data related to particular business operation that you are going to manage. This data has connected to the deployed Licence for You to Use Our Application. Business data may include, but is not limited to:

  • Readings and Dips

  • Ledger A/c Balances

  • Financial Transactions

  • Stock Inventory

All required information is service dependent, and we may use the above said user information to, maintain, protect, and improve Our services and for developing new services.

Such information will be considered as sensitive information. This information has kept secure and confidential. User only can access this information using their Login credentials from Application.

• Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To offer our Service, to present demonstration or provide informative content to you about our Product and Services.

  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.

  • With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, to contact You.

Use of Your Business Data

The Company may use Business Data for the following purposes:

  • To provide and maintain our Service, including to monitor the usage of our Service.

  • To manage Your Account: to manage Your registration as a user of the Service. The Business Data You provide can give You access to different functionalities and features of the Service that are available to You as a registered user.

  • To manage Your requests: To attend and manage Your requests to Us.

  • For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our Applications Functions and to evaluate and improve our Service, products, services, marketing and your experience.

We may share Your Business information in the following situations:

  • For business transfers: We may share or transfer Your business information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Retention of Your Business Data

For Trial User, We retain Your data for next 12 months from the date of registration or the date of trial started. after that User's business data has been deleted permanently from PetroByte Server.

For Regular User, We retain Your data as long as you are with Us, Once User has stopped from using our Service, after 60 months from that date, User's business Data has been deleted permanently from PetroByte Server.

For Left Off User, We retain your data for next 60 months from the date of Your licence has expired. after that User's business data has been deleted permanently from PetroByte Server.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to other service provider and maintained on cloud computers (virtual machines) located outside Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.

Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

Transfer of Your Business Data

We store all Users' Business Data on Cloud based Datacenters located in India using cloud platform service providers.

PetroByte Cloud Servers are manage by BeanByte, We do not work with any third party for cloud server management.

In all Other cases to transfer User's business data to other business entity or any individual, We require written consent from User. If user denied to give consent for transfer his business data then we can not transfer their data in any condition.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Other legal requirements

The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation
  • Protect and defend the rights or property of the Company
  • Prevent or investigate possible wrongdoing in connection with the Service
  • Protect the personal safety of Users of the Service or the public

The security of Your Personal Data is important to Us, We have used all possible security practices and implemented advance security layers to authenticate and validate user request through secure and encrypted transmission protocol to keep data secure, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security. We Assure that it was complete secure and Safe.

Security of Your Business Data

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data.

All information submitted on our Application is securely stored within our controlled database. The database is stored on servers secured behind a firewall; access to the servers is password-protected and file-protected and is strictly limited. However, as effective as our security measures are, no security system is impenetrable. We cannot guarantee the 100% security of our database, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the Internet.

We assure you and guarantee at our security level that Your business data absolutely Safe and Secure from access, alteration, or destruction by a breach of our physical, technical, and managerial safeguards.

Children's Privacy

Our Service does not address anyone under the age of 16. We do not knowingly collect personally identifiable information from anyone under the age of 16. If You are a parent or guardian, and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 16 without verification of parental consent, We take steps to remove that information from Our servers.

If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.

Our Service may contain links to other websites that are not operated by Us. If You click on a third party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

We shall in no way be responsible in way for your use of such sites.

Refund Policy

Thank you for subscribing to PetroByte.

Our focus is on complete customer satisfaction. In the event, if You are displeased with the services provided, we will refund back the money, provided the reasons are genuine and proved after investigation. Please read the Terms and Conditions T&C before buying Our Services, it gives all the details about the services or the product You purchase.

In case of dissatisfaction from our Software or Services, Clients have the liberty to cancel their projects and request a refund from us.

If, for any reason, You are not completely satisfied with our Software and Services, We invite You to review our policy on cancellation and Refund.

The following terms are applicable for PetroByte, and its Services that You purchased with Us.

Definitions

For the purposes of this Return and Refund Policy:

  • Company (referred to as either "the Company", "BeanByte", "We", "Us" or "Our" in this Agreement) refers to BeanByte Softwares Private Limited, Vatika Infotech City, Jaipur-302026, Rajasthan, India.

  • Software refer to computer based program that used by You to manage business operations.

  • PetroByte refer to the cloud software for financial and managerial accounting for petrol pump business.

  • Licence means a unique computer code that have rights to access PetroByte. To access App Portal, date based validity is required.

  • Validity mean a particular Date, till that date a User can access PetroByte from App Portal. after that date user is unable to access the portal.

  • Trial mean 30 days validity to access PetroByte before purchase licence validity for PetroByte by You.

  • Orders mean a request by You to purchase PetroByte Licence Validity from BeanByte by choosing available plans click here.

  • Features mean a collection of computer software programs and functions that helps You to manage Your business digitally.

  • Service refers to product training, technical support, User queries for related purchased Software.

  • Website refers to petrobyte.in, accessible from petrobyte.in, Have all details about PetroByte

  • App Portal refers to petrobyte.app, accessible from petrobyte.app, User can access PetroByte using Username and password, that was created by User.

  • You (referred to as either "User", "His", or "Client" in this Agreement) means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Trial Cancellation Policy

You are entitled to cancel Your Trial until you have not Ordered for PetroByte Licence by giving a reason for doing so.

There is no fixed deadline for cancelling the Trial, You can cancel your trial anytime till you have made Order for PetroByte Licence.

In order to exercise Your right of cancellation the Trial, You must inform Us of your decision by means of a clear statement. You can inform us of your decision by:

If the Client did not make Order for PetroByte Licence Validity after Trial gets over or more than 30 days has been passed from date for registration. In that case User account credentials will be deactivated, thus User can not access PetroByte until he makes Order.

Order Cancellation Policy

Client have to submit an Order cancellation request in case where, he made Order for PetroByte Licence, and Now he wants refund and do not want to use PetroByte in future.

You are entitled to cancel Your Order within 30 days from the date on which You registered for PetroByte Licence with giving a reason for doing so.

The deadline for cancelling the Trial is 30 days from the date on which You registered for PetroByte Licence.

In order to exercise Your right of cancellation the Order, You must inform Us of your decision by means of a clear statement. You can inform us of your decision by:

We will reimburse You no later than 30 days from the day on which We receive Your request to cancel the Order. We will use the same means of payment as You used for the Order, and You will not incur any fees for such reimbursement.

We will not refund the complete Order amount. following amount will be deducted from order amount and remaining amount will be credited to User account using same method of payment used by User at the time of Order.
List of Deductible amount from Order amount:
   INR 1200 + 18% GST as Training Charge
   INR 500 + 18% GST as Consultancy Charge

Refund Policy

We will try our best to create suitable design concepts for our clients.

In case any client is not completely satisfied with our products we can provide a refund.

In order for the PetroByte to be eligible for a refund, please make sure that:

  • make sure that You are following PetroByte Terms of Use ToU
  • make sure that You are not violating EULA .
  • make sure that User has used PetroByte for Trial on daily or alternate days basis.

In The following cases, Refund can not be proceeded:

  • Your Order cancellation date has exceeded 30 days from your registration date for PetroByte Licence.
  • User does not have genuine reason for cancelling the Order. In-respect to give genuine reason for cancellation, a clear statement is required about How PetroByte is not worthy for User?
  • User is not using PetroByte as per Instructed at Training Period or in Documentation Click Here.
  • computer system, mobile devices or network related problems at the User side.
  • User is not following Terms of Use PetroByte or Violating EULA terms.

If paid by credit card, refunds will be issued to the original credit card provided at the time of Order and in case of payment gateway name payments refund will be made to the same account.

If paid by UPI to direct Company's UPI or Bank Account, refunds will be issued to the original bank account that is connected with UPI, that was used at the time of payment

We reserve the right to refuse refund of any cancellation request related Order that does not meet the above refund conditions in our sole discretion.

Only new Users (Registered within 45 days before cancellation request date) can make cancellation request and can ask for refund.

Miscellaneous

Once Order has been cancelled by Client, after that His PetroByte Licence will be deactivated for duration of the investigation on same matter.

If Order cancelling request has been approved, His PetroByte License will be activated from approval date to refund date. On Refund date Client PetroByte Licence and Its connected data has been locked on Server. User can not access data after refund successful date.

After successful Refund, We cannot be held responsible for User business operation Data Storage, because Data can be deleted any time after refund has been successfully created into Client Account. Therefore, We recommend user to back up his data before submitting request for cancellation the Order.
